SFC Investigatory Powers & Recent Enforcement Actions Against Market Misconduct Activities
The Securities and Futures Commission (SFC) adopts a distinctive strategy to combat market misconducts, including insider trading and market manipulation, thereby safeguarding the integrity and transparency of financial markets. The regulatory framework actively engages in meticulous surveillance of trading activities, employing advanced technology and analytical tools to detect suspicious patterns indicative of illicit behaviour. By continuously monitoring market transactions, the SFC can promptly identify anomalies that diverge from standard trading practices, facilitating timely intervention and investigation.
In addition to its surveillance initiatives, the SFC conducts comprehensive investigations into suspected misconduct cases. This process typically involves collecting extensive evidence, interviewing relevant parties, and collaborating with other regulatory bodies and law enforcement agencies. The SFC’s dedication to maintaining market integrity is further evidenced by its enforcement actions, which may include imposing substantial penalties, sanctions, or even criminal charges against individuals or entities found guilty of insider trading or market manipulation. These measures not only serve to penalize wrongdoers but also act as a deterrent to others who might contemplate engaging in similar illicit activities.
The SFC collaborates closely with both local and international law enforcement agencies and regulators. Recent joint operations and investigations with these entities underscore the SFC’s commitment to addressing complex financial crimes. Notable examples include the Ching Lee market manipulation case, where three defendants were convicted and sentenced to 38 to 64 months in prison, and our recent surrender of a fugitive offender from Singapore to Hong Kong.
This seminar will delve into the key investigatory powers of the SFC in combating misconducts within the securities and futures industry in Hong Kong. Recent landmark cases will also be discussed to provide participants with deeper insights into how the SFC addresses market misconducts, including insider trading and market manipulation
